1. General Provisions

1.1. These Terms of Service ("Terms" or "Agreement") govern the use of the Evallume service, accessible at evallume.com (the "Website" or "Service"), operated by EVALLUME LLC (the "Company," "we," "us," or "our").

1.2. EVALLUME LLC is a limited liability company organized under the laws of the State of Wyoming, United States. Registered address: 30 N Gould St Ste N, Sheridan, WY 82801, United States. EIN: 372185127.

1.3. By accessing or using the Service — including creating an account, uploading files, or making a payment — you ("User," "Customer," or "you") agree to be bound by these Terms. If you do not agree, please do not use the Service.

1.4. By accepting these Terms, you also confirm that you have read and agree to our Privacy Policy.

1.5. These Terms constitute a legally binding agreement between you and EVALLUME LLC, effective from the moment of your acceptance.

2. Definitions

2.1. Key terms used in these Terms:

Website — the internet resource located at evallume.com, including all its pages and subdomains.
Service — the software platform accessible through the Website that provides Users with informational services for the interpretation of medical lab results using artificial intelligence technology.
User / Customer — a natural person who is at least 18 years of age with full legal capacity and who has accepted these Terms, or a legal guardian acting on behalf of a minor.
Interpretation — the informational service of analyzing uploaded medical lab results using AI technology.
Result — an electronic document (PDF) containing the AI-generated interpretation of the User's uploaded medical lab results.
Account — the User's personal section of the Website, accessible after registration/authentication.
Subscription — a pricing plan that provides the User with the right to receive the Service for a defined period within established limits.
Credits — prepaid units that can be exchanged for individual Interpretations.
Merchant of Record — Lemon Squeezy (Sold through Link, LLC), the entity that processes all payment transactions on behalf of the Company.

3. Description of Services

3.1. The Company provides informational services for the interpretation of medical lab results using artificial intelligence, subject to the terms and conditions of this Agreement.

3.2. The Service is strictly informational in nature. The Service is NOT and must not be construed as:

Medical services, medical care, or medical assistance of any kind;
Medical advice or consultation;
Diagnosis, prevention, or treatment of diseases;
Medical examination;
Prescription of medications, procedures, or any form of treatment;
A medical opinion or clinical judgment;
A basis for making decisions about treatment, changing therapy, discontinuing, or prescribing medications.

3.3. Interpretation Results are automatically generated by artificial intelligence algorithms without the involvement of medical professionals. Results are provided for informational purposes only and cannot replace a consultation with a qualified healthcare provider.

3.4. The Company does not engage in the practice of medicine and is not a licensed healthcare provider. You must consult qualified medical professionals regarding all health-related questions. Any health-related decisions must be made in consultation with your physician.

4. Pricing and Payment

4.1. Service pricing is published on the Website at the pricing section. All prices are in United States Dollars (USD).

4.2. The Company offers the following service formats:

Per-page pricing — a single interpretation charged per page of uploaded documents ($2.90 per page);
Credit packages — prepaid credits that can be used for individual interpretations (8 credits for $9.90, 30 credits for $29.90);
Subscription plans — access to the Service for a defined period with monthly page limits (3-month plan at $9.90/month, annual plan at $6.60/month billed yearly at $79.00).

4.3. The Company reserves the right to change pricing at any time. Updated prices take effect upon publication on the Website and do not apply to already paid Services or active Subscriptions.

4.4. All payments are processed by Lemon Squeezy (Sold through Link, LLC), our Merchant of Record. By making a purchase, you also agree to Lemon Squeezy's Buyer Terms. Lemon Squeezy handles:

Payment processing (credit/debit cards, PayPal, and other available methods);
Sales tax, VAT, and other applicable tax collection and remittance;
Invoicing and receipts.

4.5. We do not store or process your payment card data. All payment information is handled exclusively by Lemon Squeezy in compliance with PCI DSS standards.

4.6. Payment is considered complete upon confirmation from Lemon Squeezy that the transaction has been successfully processed.

4.7. Charges may appear on your bank or credit card statement as "LEMON SQUEEZY" or "LEMONSQUEEZY" rather than "Evallume."

5. Subscription Terms

5.1. A Subscription grants you the right to use the Service during the paid period within the limits of your chosen plan.

5.2. Subscription details (duration, page limits, pricing) are determined by the plan published on the Website.

5.3. Unused page limits do not carry over to the next billing period and are not refundable.

5.4. Subscriptions may be used for interpreting lab results for the User and their family members. The User is responsible for obtaining consent from family members for the processing of their personal data and medical documents.

5.5. Automatic renewal: Subscriptions renew automatically at the end of each billing period. You will be charged on the renewal date using the payment method on file, unless you cancel before renewal.

5.6. Cancellation: You may cancel your Subscription at any time through the Lemon Squeezy Customer Portal. Cancellation must be made at least 48 hours before the next billing date. After cancellation, you retain access to the Service until the end of the current paid period. No further charges will occur after cancellation.

5.7. Managing your Subscription: You can manage your Subscription (update payment method, view invoices, upgrade, downgrade, or cancel) through the Lemon Squeezy Customer Portal accessible from your Account.

6. Service Delivery

6.1. To receive the Service, you must:

Upload file(s) containing medical lab results in a supported format (PDF, JPG, JPEG, PNG, WEBP);
Indicate the sex and age of the person whose lab results are being analyzed;
Optionally provide additional information (symptoms, chronic conditions);
Register or sign in using your email address;
Complete payment.

6.2. After payment is confirmed, the Service will automatically process your uploaded documents and generate the Result. Processing typically takes 1 to 10 minutes, depending on document volume and system load.

6.3. The Result is provided as an electronic document (PDF) and is available for viewing and download in your Account.

6.4. The Service is considered rendered when the Result is generated and made available in your Account, regardless of whether you have viewed or downloaded it.

6.5. The Result is available in your Account for 30 (thirty) calendar days from the date of generation. After this period, the Company may delete the Result and uploaded documents. We recommend downloading your Result promptly.

6.6. We do not guarantee uninterrupted availability of the Service and reserve the right to perform maintenance that may temporarily limit access.

7. Quality and Limitations

7.1. Results are generated by AI algorithms based on the data contained in your uploaded documents. The quality and completeness of Results depend directly on the quality and legibility of your uploaded documents.

7.2. We do not guarantee:

Absolute accuracy, completeness, or error-free Results;
Applicability of Results to your specific clinical situation;
That Results correspond to the conclusion a qualified physician would provide;
Suitability of Results for making medical decisions;
Accurate recognition of low-quality, unclear, damaged, or partially illegible documents.

7.3. AI algorithms may produce errors, including:

Incorrect text or value recognition;
Erroneous reference range determination;
Misinterpretation of lab results;
Omission of certain parameters;
Generation of incorrect recommendations.

7.4. You acknowledge and accept these limitations and agree that Results cannot serve as a basis for self-diagnosis or self-treatment.

8. User Rights and Obligations

8.1. You agree to:

Review these Terms before using the Service;
Provide accurate information during registration and use of the Service;
Upload only medical documents for which you have lawful authorization (your own documents or documents of persons who have given consent);
Not use the Service for unlawful purposes;
Not attempt unauthorized access to the Service, its components, or other users' data;
Pay for Services in a timely manner;
Maintain the security of your Account credentials.

8.2. You have the right to:

Receive Services in accordance with these Terms;
Contact our support team regarding any Service-related questions;
Request a refund in cases described in Section 9;
Discontinue use of the Service at any time.

9. Refund Policy

9.1. Refunds are available in the following cases:

Technical inability to deliver the Service due to a fault on our end (system failure resulting in no Result being generated);
The Service was paid for but not delivered within 24 hours due to reasons attributable to us;
Duplicate charges for the same Service.

9.2. Refunds are not available when:

The Result has been generated and made available in your Account (the Service is considered rendered);
You are dissatisfied with the content of the Result;
Low Result quality is caused by low quality of documents you uploaded;
You changed your mind after payment, provided the Service has already been rendered;
The Result access period expired and you did not download it in time.

9.3. To request a refund, please contact us at support@evallume.com with your order number, payment date, and a description of the reason for the refund.

9.4. We will review your refund request within 10 (ten) business days. If approved, the refund will be processed through Lemon Squeezy and returned to your original payment method within 30 (thirty) calendar days.

9.5. For Subscription refunds, the refund amount is calculated proportionally to the unused portion of the Subscription period, provided that no Services have been used during the current period.

9.6. Please note that Lemon Squeezy, as the Merchant of Record, reserves the right to issue refunds within 60 days of the original transaction to prevent chargebacks, even in cases where our refund policy would otherwise not apply.

10. Limitation of Liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damage to health, emotional distress, loss of profits, or any other losses arising from:

Use of or inability to use the Result;
Any decisions you make based on the Result;
Inaccuracy, incompleteness, or errors in the Result;
Delays or inability to provide Services due to force majeure, technical failures, or actions of third parties;
Unauthorized access to your data not caused by our negligence;
Your actions or inactions, including self-diagnosis and self-treatment.

10.2. You use the Result at your own risk. All responsibility for the interpretation and use of information contained in the Result lies with you.

10.3. Our total aggregate liability under these Terms shall not exceed the amount you actually paid for the specific Service giving rise to the claim.

10.4. We are not liable for the operation of third-party services, including payment processors, email services, internet providers, and other third-party services.

10.5. We are not liable for failure to provide Services caused by force majeure events, including but not limited to natural disasters, armed conflicts, government actions, network or power outages, or malicious software.

10.6. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.

11. Intellectual Property

11.1. All rights to the Service, including its design, software code, algorithms, databases, trademarks, and other intellectual property, belong to the Company or are used under valid licenses.

11.2. You are granted a non-exclusive, non-transferable right to use the Service solely for your personal, non-commercial purposes in accordance with its intended functionality.

11.3. You may not:

Copy, modify, distribute, decompile, or reverse-engineer the Service's software;
Use the Service to create competing products;
Use automated means (bots, scripts) to interact with the Service;
Resell or transfer access to the Service to third parties on a commercial basis.

12. Privacy and Personal Data

12.1. Processing of your Personal Data is governed by our Privacy Policy, which is an integral part of these Terms.

12.2. By accepting these Terms, you consent to the processing of your Personal Data as described in the Privacy Policy, including the processing of health data (Special Category Data under GDPR Article 9) with your explicit consent.

12.3. You are responsible for obtaining consent from third parties whose medical documents you upload to the Service.

13. Dispute Resolution

13.1. We encourage you to contact us first at support@evallume.com to resolve any disputes informally.

13.2. Any dispute arising out of or relating to these Terms that cannot be resolved informally shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Sheridan, Wyoming, or remotely at your election. The arbitration shall be conducted in English.

13.3. Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13.4. Small claims exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

13.5. These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

13.6. For Users in the EU: Nothing in this Section limits your right to bring proceedings before the courts of the EU Member State in which you are domiciled, or to lodge a complaint with a supervisory authority, as provided by applicable EU law.

14. General Provisions

14.1. These Terms take effect upon your acceptance and remain in force until all obligations of both parties are fulfilled.

14.2. We reserve the right to modify these Terms at any time. The updated version takes effect upon publication on the Website, unless a different effective date is specified.

14.3. Continued use of the Service after changes are published constitutes your acceptance of the updated Terms.

14.4. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.5. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce such provision in the future.

14.6. These Terms, together with the Privacy Policy and any applicable Lemon Squeezy Buyer Terms, constitute the entire agreement between you and the Company regarding the Service.
